Terms of service
These General Terms and Conditions (hereinafter referred to as "General Terms and Conditions") govern all relationships in the provision of services between: RR food delivery, ID No.: 096 74 608, with its registered office at: U Cukrovaru 141, 250 63, Mratín (hereinafter referred to as "Supplier") and the customer (hereinafter referred to as "Client").
Definitions
For the purposes of these General Terms and Conditions, the following terms have the following meanings:
- "Yeskrabičky Program" is a regular healthy eating program that includes the preparation and delivery of daily meal sets according to the number of daily/weekly/monthly cycles selected and ordered by the Client from the Supplier, to the place specified by the Client or to the collection point (hereinafter referred to as "Yeskrabičky Program").
- "Daily Set" of meals is a balanced combination of food for one day, delivered to the Client by the Supplier. The daily set of meals will be individually tailored to the optimal intake of macronutrients according to the data from the initial questionnaire completed by the Client and the input data. The food in each daily set is neatly arranged, labeled, packaged, and delivered to the Client once a day to the place specified by the Client or to the collection point (hereinafter referred to as "Daily Set").
- "Client" is a natural and/or legal person ordering the Yeskrabičky Program on the website www.yeskrabičky.cz, as a person interested in the services offered consisting of regular eating in the form of nutritionally balanced and valuable food. The Client undertakes to pay the Supplier the agreed remuneration for these services (hereinafter referred to as "Client").
- "Customer Line" is the phone number: +420 724 282 066 of customer support, which is available to the Client Monday to Friday from 10:00 a.m. to 5:00 p.m. (hereinafter referred to as "Customer Line").
- "Contract" or also confirmed or accepted Order or offer means for the purposes of these General Terms and Conditions (depending on the subject of the contract) in particular a purchase contract or a contract for work or an unnamed contract, or another similar contract, which is concluded in accordance with the subject of the seller's business, as is evident from the entry in the commercial register (hereinafter referred to as "Contract").
- "Order" means for the purposes of these General Terms and Conditions the Client's proposal to conclude a Contract delivered to the Supplier via the website www.yeskrabičky.cz. The order must contain at least the data specified in Article II. point iv. without these essentials, the document cannot be considered an Order within the meaning of these General Terms and Conditions (hereinafter referred to as "Order").
- "List of Allergens" is a list of ingredients that the Supplier allows the Client to exclude from the delivered Program. The ingredient that the Client wishes to exclude will either be omitted or replaced (if replacement is possible given the nature of the dish) (hereinafter referred to as "List of Allergens").
- "Force Majeure" is an extraordinary, unforeseeable, and insurmountable obstacle and/or event that is not caused by any of the participants, i.e., the Supplier and the Client, and which is unforeseeable and insurmountable at the time of the conclusion of the contract, unavoidable, beyond the control of the participants, and which makes the fulfillment of obligations impossible. Force majeure includes, but is not limited to, epidemics, armed conflicts, and natural disasters, provided that they meet the requirements of the previous sentence (hereinafter referred to as "Force Majeure").
Order
The Yeskrabičky Program can be ordered in the following ways:
- Through a purchase in the e-shop and completing the cart on the website www.yeskrabičky.cz, where the purchase contract is concluded by confirming the Order by the Supplier via email, by phone, or by delivering the Program.
- Through an online form located on the website www.yeskrabičky.cz, where the Contract is concluded by confirming the Order by the Supplier by phone.
- By email to the email addresses listed on the website www.yeskrabičky.cz (info@yeskrabicky.cz), where the Contract is concluded by confirming the Order by the Supplier via email, by phone, or by delivering the Yeskrabičky Program (in the case of repeated delivery of the Yeskrabičky Program, where the Client responds with a new Order to the Supplier's email announcing the approaching end of the previous Order).
The Order must contain the following data: name, surname, billing address, delivery address, contact phone, contact email, selected Yeskrabičky Program including its duration, and allergens.
The Client is responsible for providing the correct contact phone, contact email, and delivery address. If the Client provides these details incorrectly or does not provide them at all, the Supplier is not responsible for the non-delivery of the Yeskrabičky Program.
The Yeskrabičky Program must be ordered at least three (3) working days before the day on which the Yeskrabičky Program is to be delivered. Each order placed is a binding proposal to conclude a purchase contract.
The Supplier will confirm the receipt of each Order via email communication ("Order Confirmation").
The Order Confirmation represents the confirmation of the content of the concluded Contract between the Supplier and the Client, including the specification of the ordered goods, the price of the goods, and the expected delivery date of the goods.
Unless otherwise stipulated in the concluded purchase contract or other written agreement between the Supplier and the Client, the Client expresses his consent to these General Terms and Conditions by sending the Order.
If the Client is allergic to any food, he is obliged to inform the Supplier immediately by selecting from the List of Allergens when creating the Order on the e-shop www.yeskrabičky.cz or by phone on the Customer Line. The Supplier thus allows the Client to exclude a maximum of three (3) foods listed in the List of Allergens. Such a Client will be delivered the Yeskrabičky Program without the ingredients to which the Client is allergic. If the food to which the Client is allergic is not listed in the List of Allergens, the Supplier reserves the right not to deliver the Yeskrabičky Program to the Client.
Change/Cancellation of Order
The Client is obliged to inform the Supplier of changes to the Order, such as the cancellation of the Yeskrabičky Program Order and/or the change of the ordered program, at least three (3) working days before the day on which the Yeskrabičky Program is to be delivered. Changes that the Client informs the Supplier of within a shorter period than stated in the previous sentence will not be accommodated by the Supplier, the Yeskrabičky Program will be duly delivered to the Client, and the Client is obliged to pay the Supplier the full price for the delivered Yeskrabičky Program.
If the Client changes/cancels the Order by notifying the Supplier's Customer Line no later than three (3) full working days before the delivery day, excluding the delivery day itself, i.e., the delivery day minus 3 full working days), the Supplier will make the change/cancellation of the changed/canceled Order.
In the event of a change, i.e., shortening of the Order, or total cancellation of the Order, the Client will be refunded the amount for the unused days of the Order. In the event of a change/shortening of the Order, the Supplier reserves the right to charge the Client a fixed administrative fee of CZK 1000 (in words: one thousand Czech crowns) payable within three (3) days of the delivery of the notification of the change and/or total cancellation of the Order.
In the event of a change, i.e., shortening of the Order, or total cancellation of the Order, the Supplier reserves the right to return the Fee or any other financial performance to the Client in cash.
Delivery of Order
The Supplier undertakes to prepare the Yeskrabičky Program according to the Client's Order, deliver the Yeskrabičky Program to the place specified by the Client, and hand it over to the Client in the manner specified in paragraph 2 of this article of the General Terms and Conditions.
The driver delivering the Yeskrabičky Program ("Carrier") will hand over the Daily Set of meals (i) to the Client, (ii) to a person designated by the Client, or (iii) to another person present at the place specified by the Client as the delivery place of the Yeskrabičky Program. At the moment of handing over the Yeskrabičky Program to the Client, the risk of damage to the goods passes to the Client.
The Daily Set of meals is delivered in a chilled state. The Daily Set of meals must be kept chilled (at a maximum of +six (6) degrees Celsius) until consumption. The Supplier is not responsible for the quality of the Yeskrabičky Program if the storage conditions are violated after it is handed over to the Client.
The Supplier is not responsible for defects caused by the Client's actions that are contrary to these General Terms and Conditions.
Upon receipt of the Daily Set, the Client is obliged to perform a physical inspection of the delivered goods. If the Client finds obvious defects or missing goods, or damaged packaging during the inspection, he is obliged to immediately notify the Supplier. Alternatively, proceed otherwise in accordance with the Supplier's complaint procedure.
he daily set of meals must be consumed by the date indicated on the label. Once the box is opened, its contents must be consumed immediately.
The daily set of meals will be delivered to the place specified by the Client within the time frame specified in the carrier's SMS, which the Client will receive in advance of the delivery. The Client is aware that in exceptional cases the delivery time may change, taking into account the traffic situation and other similar events, for example, but not exclusively due to Force Majeure. The Client will be informed of this change by phone, SMS, or email.
If the Client needs to change the agreed delivery time to the place specified by the Client, the Client is entitled to make this change via email or on the Supplier's Customer Line, no later than forty-eight (48) hours before the day preceding the delivery of the daily set of meals.
In the event of Force Majeure, the Supplier is not responsible for the unsuccessful delivery of the Yeskrabičky Program and the Client is not entitled to compensation.
Price of the Yeskrabičky Program
The Client undertakes to accept the ordered Yeskrabičky Program at the place specified by the Client and to pay the Supplier the Purchase Price for the Yeskrabičky Program properly and on time.
The Client will pay the Supplier the Purchase Price in the following ways:
- To the Supplier's bank account, which is indicated on the relevant tax document - invoice ("Invoice") based on the issued Invoice by bank transfer or other form under the variable symbol specified in the Invoice and/or
- Pay the amount for the selected program online on the e-shop www.yeskrabicky.cz and make the payment using one of the available payment methods.
Payment methods include:
- Credit/debit card
- Apple/Google pay
- Paypal
The Supplier unilaterally reserves the right to allow the Client to pay based on a tax document - invoice. If the payment method on the Invoice is available to the Client, the Supplier will invoice the Purchase Price to the Client with a due date no later than seven (7) days from the date of the Invoice. The Supplier reserves the right to issue the Invoice to the Client on the day the Client orders the Yeskrabičky Program and send the Invoice to the Client via email.
The Purchase Price is considered paid at the moment it is credited to the Supplier's bank account.
The Yeskrabičky Program starts running when the amount for the selected program is credited to the Supplier's account.
In the event of a delay in the payment of the Purchase Price, the Supplier reserves the right to demand from the Client the payment of interest on arrears, which amounts to 0.25% of the outstanding amount for each day of delay.
In the event of a delay in the payment of the Purchase Price, the Supplier reserves the right to refuse the delivery of the ordered Yeskrabičky Program until the full payment of the Purchase Price for the previous deliveries of the Yeskrabičky Program.
The Purchase Price of the Yeskrabičky Program is set on the website www.yeskrabicky.cz and is final.
The Purchase Price of the Yeskrabičky Program is stated without VAT.
Final Provisions
All conditions not expressly regulated by the purchase contract and the General Conditions are governed by the generally binding legal regulations of the Czech Republic, in particular the provisions of Act No. 89/2012 Coll., the Civil Code, as amended.
These binding General Terms and Conditions are valid and effective from the date of their publication on the Supplier's website. If any provision of the General Terms and Conditions is subsequently found to be invalid or ineffective, this does not mean the invalidity of the General Terms and Conditions as a whole. The Supplier undertakes to replace such invalid or ineffective provision with another provision.
All disputes arising from the Contract or these General Terms and Conditions or in connection with them will be decided by the general courts of the Czech Republic, with the locally competent court of first instance being the court in whose district the Supplier has its registered office at the time of the initiation of the relevant court proceedings.
If any provision of these General Terms and Conditions is found to be invalid, ineffective, void (null), or unenforceable, such invalidity, ineffectiveness, voidness (nullity), or unenforceability does not cause the invalidity, ineffectiveness, voidness (nullity), or unenforceability of the entire Contract or the entire General Terms and Conditions, with the entire Contract and these General Terms and Conditions being interpreted as if they did not contain the individual invalid, ineffective, void (null), or unenforceable provisions, and in this sense, the rights of the contracting parties arising from the Contract and these General Terms and Conditions will be interpreted and enforced.
The rights of the Client arising from the Contract or these General Terms and Conditions may not be assigned without the prior written consent of the Supplier.
The Supplier reserves the right to unilaterally change or supplement these General Terms and Conditions.
The General Terms and Conditions are published on the website: www.yeskrabicky.cz
The General Terms and Conditions are valid and effective from January 1, 2025, and fully replace all previous general terms and conditions.
RR food delivery s.r.o., U Cukrovaru 141, 250 63, Mratín, ID No.: 09674608 ("Supplier"). Complaint Procedure of the Supplier (hereinafter referred to as "Complaint Procedure").
Terms beginning with a capital letter have the same meaning as the terms defined in the General Terms and Conditions.
"Goods" means each Daily Set of one to five meals, i.e., a set of five meals, intended for immediate consumption in accordance with the conditions of the Yeskrabičky Program, as well as dietary supplements offered for sale on the e-shop.
Introductory Provisions
The Complaint Procedure specifies the procedure of the Client and the Supplier - RR food delivery s.r.o., U Cukrovaru 141, 250 63, ID No.: 09674608, VAT No.: CZ09674608 (hereinafter referred to as "Supplier"), in the event that, despite the Supplier's best efforts to maintain the high quality of the offered Goods, there is a justified reason on the part of the Client to exercise rights in terms of liability for defects in the delivered Goods.
Prevention
Before definitively selecting the offered Goods, including their delivery, the Client is obliged to consider the suitability of the Goods ordered by him, the price, and to familiarize himself in detail with the General Terms and Conditions and the Complaint Procedure, which are binding.
Throughout the use of the delivered Goods, the Client must pay sufficient attention to the basic rules for using these Goods, published on the Supplier's website www.yeskrabicky.cz. In particular, it is necessary to consider all factors adversely affecting the durability of the Goods, such as storage and heating, using the goods for an inappropriate purpose, etc.
Basic Conditions for Complaints about Goods
If a defect occurs in the delivered Goods during the warranty period, the Client has the right to complain about this defect. A defect in the delivered Goods means a change in the properties of the Goods, the cause of which is the use of unsuitable or poor-quality raw materials from which the Goods are made, the packaging material of the Goods, the expired expiration date (minimum shelf life) of the Goods on the day of their delivery to the Client. A defect cannot be considered a change in the properties of the Goods that occurred during the warranty period due to improper use, insufficient or inappropriate storage or heating, partial or complete consumption, due to natural changes in the raw materials from which the Goods are made, due to any devaluation by the Client or a third party or other improper intervention. A defect in the delivered Goods cannot also be considered so-called subjective unpalatability/unfitness of the Goods, if the Goods show the standard signs of palatability that the Goods should have in the case of their proper use, consumption. If the Client exercises the right of liability for defects in the delivered Goods in a proper manner, the Supplier is obliged to decide on the legitimacy of the complaint within three (3) working days.
A complaint is considered properly filed if the complained Goods are delivered completely and at the same time the purchase of the complained Goods from the Supplier is proven.
A complaint, including the removal of the defect, means the replacement of the complained Goods, which will be delivered to the Client after the last day of the program.
Place and Method of Filing a Complaint about Goods
The Client must file a complaint in writing at the Supplier's premises. In the written notice, the Client is obliged to sufficiently describe the decisive facts on the basis of which he is filing a complaint about the Goods. At the same time, the Client is obliged to sufficiently prove the existence of circumstances justifying him to file a justified complaint about the delivered Goods.
The Supplier is obliged to confirm in writing to the Client when the right of liability for defects in the Goods was exercised, information on the method of resolving the complaint, and the duration of the complaint.
Deadlines for Filing a Complaint about Goods
The right of liability for defects in the Goods must be exercised within the warranty period. The complaint must be filed without undue delay, immediately after the defect in the Goods has occurred. Any delay in the continued use of the Goods may be grounds for rejecting the complaint. The warranty period for the Goods is twenty-four (24) hours and begins on the day the Goods are received by the Client.
Further Specification of the Term Goods and Defects of Goods
Goods are considered to be each Daily Set of one to five meals, i.e., a set of nutritionally balanced five meals, intended for immediate consumption in accordance with the conditions of the Yeskrabičky Program. Goods also include dietary supplements offered for sale on the e-shop. A defect in the Goods is considered to be, in particular, the incompleteness (incompleteness) of the daily set of one to five meals and a condition that contradicts the generally binding regulations in the field of consumer protection and hygiene, as well as hygiene standards.
Final Provisions
The Complaint Procedure was prepared in accordance with Act No. 40/1964 Coll., the Civil Code, as amended, and further in accordance with Act No. 643/1992 Coll., on Consumer Protection, as amended, as well as other generally binding first regulations.
The Supplier reserves the right to change or supplement this Complaint Procedure at any time at its discretion, but in accordance with generally binding legal regulations. The rights and obligations of the Supplier and the Client are governed by the wording of the Complaint Procedure valid at the time of the proper filing of the complaint by the Client.
The Client's right to file a complaint about a defect in the Goods is exhausted after he has exercised his right and asked the seller to remove the defect in the Goods according to this Complaint Procedure and the terms and conditions, and regardless of the outcome of the complaint, he is no longer entitled to file a complaint repeatedly for the same unique defect (not a defect of the same kind).
By confirming each Order of the Supplier's Goods, the Client confirms that he has read and agrees with this Complaint Procedure.The Supplier may change or supplement the wording of this Complaint Procedure at any time. However, this provision does not affect the rights and obligations arising from purchase contracts concluded before the effective date of the new Complaint Procedure.
All provisions of this Complaint Procedure are separable. If any provision is found to be invalid, ineffective, or unenforceable, this will not affect the validity, effectiveness, or enforceability of the remaining rights and obligations arising from this Complaint Procedure.
